Article 1: Introduction
1.1 This User Agreement is signed by Securify Information Technologies And Security Training Consultancy Indusrty And Trade Incorporated and the legal person who registers as a User (“User(s)”) on the Securify identity mobile application and/or www.securifyidentity.com domain website (“Website”). The Agreement will be active upon its acceptance by the User in the electronic environment and will remain in effect unless terminated by the Parties in accordance with the procedures set forth in this Agreement.
1.2 The subject of the contract is the provisions of the Law No. 6502 on the Protection of Consumers and other relevant legislation regarding the sale and delivery of the products and/or services requested by legal person signing this agreement via the mobile application and/or website of Securify.
1.3 With this Agreement, Securify has the right to change or amend the Agreement unilaterally and not return against the Users, in order to ensure the continuity of its intermediary services, to comply with future technical necessities or to comply with the legislation. In case of any change, Securify will publish the current terms of use on the Website with a new date update under the same link, and will notify its users by e-mail or mobile notification if necessary and submit it to their approval. The updated current Agreement will be valid from the moment it is published on the mobile application and/or Website, and the use of the Website or its services will be subject to the terms of the renewed Agreement from that moment.
1.4 These Terms do not apply to "Corporate Broadcast Subscriptions" for "Corporate User", "Corporate Users" subject to written agreements between Securify and the customer.
1.5 The user accepts, declares and undertakes that he/she accepts the regulations in this Agreement and that the information provided is his/her own and correct.
Article 2: Copyright Policy
2.1. The right of the software which is used in the design of Securify Identity Mobile Application, Web Site and to set database belongs exclusively to Securify. Copying or using of aforementioned software, reverse engineering on the using softwares and technologies are certainly prohibited.
2.2. The right of use of software, visual and audial designs, writings, logos, graphics and any other material are belong exclusively Securify. Copying, duplicating and/or using the information, content and/or software used in the design, content and database creation of the Mobile Application beyond the benefit specified under this Agreement; copying, distributing, processing and other using of any kinds of picture, text, image, file, etc. data contained within the application is strictly prohibited.
2.3. You may temporarily download a copy of the materials (information or software) contained in the website or mobile application for temporary personal, non-commercial viewing only. You must not otherwise reproduce, modify, copy, distribute or commercially use any content without the written consent of Securify.
Article 3: Prohibited Transactions
3.1. The User is strictly prohibited from taking actions that may threaten the security of the Application or Securify Systems and/or may cause a harm to other users, operating other softwares belong to the application, making any attempt will obstruct other users benefiting from the application, placing a disproportionate load on the system or application in such a way as to give these results; accessing, copying, deleting, modifying or making an unauthorized try thereaway; using softwares which will obstruct the application run, trying to use or hindering the operation of any kind of software, hardware and servers, causing a break down, reverse engineering, organizing attacks, keeping busy or interfering these in other ways, trying to provide an access to Securify’s servers are certainly forbidden.- In addition to this, in the case of a violation of Securify’s Intellectual, Industrial and other Property and usage rights (including the amount of compensation demanded from Securify due to the damages incurred by third parties involving the licensors) the User is liable from immediately compensating all harms with all secondaries.
Article 4: Membership System
4.1. The user's member information is deemed to be correct and the services offered or to be offered by Securify will be presented to the address information to be defined by the User. Responsibility for damages incurred by Users or third parties due to inaccurate or incomplete information in question belongs to the relevant User.
4.2. Securify Identity may immediately suspend or cancel Users registration for any reasonable purpose or if you violate these Terms of Use.
4.3. You can cancel your registration at any time by contacting us. However, if you cancel your registration, you must stop using Securify's website, Securify Identity Mobile Application and Securify services. The cancellation or suspension of your registration does not affect any legal rights.
Article 5: Links to Other Websites
5.1. Securify's website and/or mobile applications may contain links to other websites. Unless expressly stated, these sites are not under the control of Securify.
5.2. On web sites which give link via mobile application, Securify has no responsibility from the contents published by third parties including User. The trueness and the compact of compliance with law of informations, contents, visual and audial images provided or published by any third party; are in the responsibility of the person who makes this act. Securify undertakes and guarantees the security, trueness and the compliance with law of the services and the contents which provide by the third parties.
Article 6: Delimitations of Liability
6.1. Securify is not liable for the acts, negligences and behaviors of any third party, Securify users, advertisers and/or sponsors in relation to the use of the Mobile Application or website, as far as legally permitted under the applicable laws.
6.2. Securify ; takes reasonable cautions aiming protection. However, it does not accept responsibility for the consequences that may arise if the User's information captures by malicious persons as a result of attacks on User’s computer network and the existing database information on this network, and if they are used maliciously.
6.3. Access to and quality of the content presented through the Mobile Application and Mobile Application is largely based on the quality of the service provided by the relevant internet service provider and that Securify has no responsibility for the issues arising from the quality of the service in question, the functioning of the Mobile Application is not free from defects and that from time to time technical malfunctions may encounter access barriers are accepted and declared by the User.
6.4. User accepts and declares that he/she has the legal competency to conclude this Agreement and in the event of the opposite, unless he/she makes a notice immediately it has all the responsibility. Securify will not accept any indirect, particular, incidental, or consequential damages, including but not limited to loss of profit, loss of goodwill, or reputation, as a result of the Users' usage of the Securify Services, especially the mobile application, or due to the Users' other actions, to the extent permitted by applicable law, will be not liable for punitive damage.
Article 7: General Terms
7.1. Membership usage rights, user name and password cannot be transferred to others. The user is personally responsible for the use and management of all the information he has declared, including membership information, and will not allow third parties to use this information by himself or through it. Every transaction performed with the User's membership information and password will be deemed to have been carried out by the User himself.
7.2. Securify has the right to unilaterally change the account activation process and access steps for the Mobile application at any time, provided that it is in accordance with the legislation, and in this case, the User will need to enter different/additional information in order to use the Mobile Application.
7.3. In all transactions to be carried out within the scope of this Agreement, the User must follow the laws, morality and good manners, the principles of honesty, with the conditions may be published on the mobile application and Securify web site from time to time, the User must not act behaviors which can obstruct the operation of the application with any kind of method, not engage in acts that infringe or threaten to violate the rights of third parties.
7.4. This agreement is governed by accordance with the laws of the Republic of Turkey.
7.5. In all disputes that arise from this Agreement, the provisions in this text shall be applied first, and the Laws of the Republic of Turkey shall apply in cases where there is no provision. Istanbul (Çağlayan) Courts and Enforcement Offices will be authorized to resolve disputes arising from the implementation of the Agreement.
